Acceptable Use Policy
What you can and cannot do with the WP Smart Consent plugin, your license, and wpsmartconsent.com. Covers prohibited uses, license abuse, and what triggers account or license termination.
A Note Before You Read
This Acceptable Use Policy (“AUP“) explains what you can and cannot do with the WP Smart Consent plugin, your License, and wpsmartconsent.com. It applies in addition to our Terms of Use — the rules below are specific examples, not replacements, for the obligations in that agreement.
If you violate this AUP, we may take action without prior notice, ranging from a warning to immediate License termination without refund, as described in Section 6 below.
1. Who This Policy Applies To
This AUP applies to:
- Any person or entity that purchases, uses, or installs the WP Smart Consent plugin (the “Plugin“)
- Any person or entity that visits, accesses, or uses wpsmartconsent.com (the “Website“)
- Anyone acting on behalf of the above, including agency employees, contractors, and clients
By purchasing a License, installing the Plugin, or otherwise using our Services, you agree to comply with this AUP.
2. License Enforcement (Using the Plugin Within Your Tier)
License abuse is the single most common violation we encounter. The following uses are prohibited.
2.1. Site-Count Abuse
You may not:
- Install or activate the Plugin on more Sites than your License tier permits
- Circumvent, disable, or tamper with the Plugin’s license validation mechanism
- Use multiple unrelated purchases to create a “stacked” License across more Sites than any single tier would allow
- Share License keys with other individuals, companies, or agencies that are not covered by your License
What we do to detect this: The Plugin’s license validation system records the domain, WordPress version, and Plugin version on each activation (see our Privacy Policy). If we identify unusual activation patterns inconsistent with your purchased tier, we may investigate and, if appropriate, revoke the License.
2.2. Agency and “Unlimited” License Abuse
The Agency Yearly License and the Lifetime License permit use across “unlimited” or very high Site counts to accommodate agencies and freelancers. These Licenses do not permit:
- Distribution of the Plugin as part of a productized offering, theme package, hosting bundle, page-builder template, or similar downstream product
- Use on throwaway or disposable domains created for the purpose of testing license limits
- Sharing the License with independent third parties (such as subcontractors operating outside your direct control)
- Any use that a reasonable observer would view as reselling or wholesaling the Plugin
2.3. License Resale
You may not resell, rent, lease, sublicense, or otherwise transfer your License to another person or entity without our prior written consent. Agencies legitimately using the Plugin on client Sites are not considered reselling, provided the agency remains the License holder and the party responsible for compliance with our Terms.
3. Prohibited Uses of the Plugin
You may not use the Plugin to:
- Send unsolicited or non-consented marketing communications, including violations of CAN-SPAM, CASL, TCPA, GDPR, ePrivacy Directive, or any similar law in any jurisdiction
- Collect, store, or forward personal data from visitors who have not lawfully consented, in violation of GDPR, CCPA, or other applicable privacy law
- Forward subscriber data to a CRM or destination for which the subscriber has not provided informed consent
- Misrepresent the purpose of the consent checkbox — for example, labeling it as “accept the Terms” when it is actually used for marketing opt-in
- Pre-check the consent checkbox for visitors in jurisdictions where pre-checked boxes are prohibited (including the EEA under GDPR)
- Facilitate phishing, scam, or fraud campaigns using collected subscriber data
- Distribute malware, spyware, or harmful code through subscriber communications enabled by the Plugin
- Engage in subscription list-buying or list-laundering — using the Plugin to “clean” or legitimize lists obtained without consent
- Harvest email addresses from third-party sources and route them through the Plugin to create the appearance of opted-in subscribers
- Use the Plugin on content that is illegal in the jurisdiction where it is served, including content that exploits or endangers children, promotes violence, or incites hatred
4. Prohibited Uses of wpsmartconsent.com
You may not:
- Attempt to gain unauthorized access to any part of the Website, our servers, our licensing systems, or any connected system
- Attempt to probe, scan, or test the vulnerability of our systems, or to breach security or authentication measures
- Interfere with or disrupt the Website, including by overloading, flooding, or spamming our servers
- Scrape, crawl, or automatically extract content from the Website in violation of our
robots.txtor equivalent instructions - Reverse-engineer, decompile, or disassemble the Plugin or the Website beyond what applicable law expressly permits
- Access or attempt to access another customer’s account, License key, or support tickets
- Use automated tools, bots, or scripts to interact with our purchase, support, or licensing systems except where we provide an official API
- Submit false, misleading, or fraudulent information during purchase, support, or refund requests
- Create multiple accounts to circumvent bans, suspensions, or refund policies
- Submit chargebacks without first contacting us in good faith (see Terms of Use Section 4.5)
5. Prohibited Conduct Toward Our Staff and Community
You may not:
- Harass, threaten, intimidate, or abuse our staff, contractors, or support personnel
- Use support channels to submit spam, off-topic content, or repeated frivolous requests
- Submit support tickets that contain hate speech, profanity directed at our team, or discriminatory language
- Impersonate our staff, our company, or another customer
- Make knowingly false accusations, fraudulent refund claims, or bad-faith disputes
Support is a human service provided by real people. Civility is non-negotiable. We will terminate support privileges — and, for serious cases, Licenses — for customers who repeatedly abuse our team.
6. Enforcement
We enforce this AUP in good faith and in proportion to the severity of the violation.
6.1. Informal Warning
For minor, first-time, or ambiguous violations, we may contact you to explain the issue and ask you to correct it. Most violations are resolved at this stage.
6.2. Temporary Suspension
For repeated, deliberate, or more serious violations, we may:
- Suspend your License activation on one or more Sites
- Suspend your access to the Website, support channels, or your License dashboard
- Restrict your ability to make new purchases
Suspensions typically last until the violation is resolved and you have agreed in writing to comply with this AUP going forward.
6.3. License Termination
For severe or repeated violations — or for any single violation that causes material harm — we may:
- Permanently terminate your License without refund
- Blacklist your email address and payment information from future purchases
- Dispute any pending chargebacks or refund requests
6.4. Reporting to Authorities
For violations that involve illegal activity — including fraud, unauthorized access, distribution of malware, violation of privacy law that causes harm to individuals, or exploitation of children — we will report the violation to the appropriate law enforcement or regulatory authority. We will cooperate with lawful investigations.
6.5. No Refunds for Terminated Licenses
Licenses terminated for AUP violations are not eligible for refunds, and any fees previously paid are forfeit. This includes the 14-day refund window described in our Terms of Use.
6.6. Our Discretion
We investigate suspected violations in good faith. We may decide in our sole discretion whether a violation has occurred and what enforcement action is appropriate. Our enforcement decisions are final, subject only to the dispute resolution process in our Terms of Use.
7. Reporting Abuse
If you believe another customer is abusing the Plugin, reselling a License improperly, or otherwise violating this AUP, please report it to us at contact@wpsmartconsent.com with “AUP Report” in the subject line.
Please include:
- A clear description of the suspected violation
- The domain name(s) involved, if known
- Any evidence you can share (screenshots, URLs, license key fragments)
- Your relationship to the matter (affected party, competitor observation, concerned user, etc.)
We review every report. We do not disclose the identity of the reporter to the reported party, except where required by law or where the reporter has consented.
8. Our Rights Under This Policy
We reserve the right to:
- Investigate suspected violations, including by reviewing License activation logs, support ticket content, and Website server logs as described in our Privacy Policy
- Contact you to discuss suspected violations and request information or clarification
- Take enforcement action at any time, with or without prior notice, consistent with Section 6
- Update this AUP to address new abuse patterns or changes in applicable law
9. Changes to This Policy
We may update this AUP from time to time. The “Last Updated” date in the hero above always reflects the most recent revision. For material changes, we will provide reasonable notice by email (if we have your email on file) or by a prominent Website notice. Your continued use of the Services after a material change constitutes acceptance of the revised AUP.
10. Relationship to Other Documents
This AUP is a supplement to, not a replacement for, our Terms of Use. Where this AUP and the Terms of Use overlap, both apply. Where they conflict, the Terms of Use govern for matters of contract interpretation; this AUP governs for matters of specific prohibited conduct and enforcement.
